Separate Maintenance cases are less common, but are very similar to divorce actions. They are more commonly known as “legal separations.”  When parties file a Complaint for Separate Maintenance they go through the same process as a divorce, however, at the end the parties are still married.  The time frames for a separate maintenance are the same as for a divorce.  Like a divorce, the parties will divide assets and debts; determine custody and parenting time; and determine support.  Our office is experienced in separate maintenance cases and can assist you in determining if it is appropriate in your situation.
