The Court looks at various considerations to determine when an award of spousal support is warranted.  The basic determination for awarding spousal support is the need of one spouse and the ability of the other party to pay.  The court looks at the following considerations when making a determination: length of the marriage; age and health of the parties; fault on the part of either party; education level of the party to receive  support; and work history.  An award of spousal support is not a guarantee and is looked at on a case by case basis.  Our office can assist you in evaluating your particular facts to determine the probability of an award of spousal support in your case.
